Please read these Terms of Use carefully before using the Moments app. By downloading, installing, or using Moments, you agree to be bound by these terms. If you do not agree, do not use the app.
1. Acceptance of Terms
These Terms of Use constitute a legally binding agreement between you and Moments (“we”, “our”, or “us”). These terms apply to your use of the Moments application on any platform, including iOS and any associated services.
2. Eligibility
You must be at least 13 years old to use Moments. By using the app, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have parental or guardian consent.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@usemomentsapp.com if you suspect unauthorized use of your account.
4. Your Content
You retain full ownership of all voice recordings, journal entries, and other content you create in Moments (“Your Content”). By using Moments, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the service to you.
You are solely responsible for Your Content. You agree not to record or store content that:
- Violates any applicable law or regulation
- Infringes on the rights of any third party
- Is defamatory, obscene, or harmful
- Contains malware or malicious code
5. Acceptable Use
You agree not to:
- Use the app for any unlawful purpose
- Attempt to reverse-engineer or decompile the app
- Interfere with or disrupt the app’s infrastructure
- Access or attempt to access other users’ data
- Use the app to harass, threaten, or harm others
- Scrape, copy, or redistribute our content or technology
6. Subscription and Payments
Moments may offer free and premium features. Premium features may require an in-app purchase or subscription processed through Apple’s App Store. All purchases are subject to Apple’s terms and conditions. We do not process payment information directly. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
7. Intellectual Property
All software, design, trademarks, and other intellectual property in the Moments app (excluding Your Content) are owned by us or our licensors. You may not reproduce, distribute, or create derivative works without our express written permission.
8. Disclaimer of Warranties
Moments is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses. Your use of the app is at your sole risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Moments, including loss of data, loss of profits, or any other losses. Our total liability to you for any claims arising from these terms or your use of the app shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your access to Moments at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the app and requesting account deletion at contact@usemomentsapp.com.
11. Changes to Terms
We may update these Terms of Use at any time. Continued use of the app after changes constitutes acceptance of the new terms. We will notify you of material changes through the app or by email.
12. Governing Law
These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, unless prohibited by applicable law.
